How can they get away with that?! I'd be afraid of a lawsuit.

Better buy it quick before Hasbro shuts them down.

Usually they just send a cease and desist letter, but if Hasbro smells any profits, they can bring a lawsuit. Typically this stuff goes unnoticed under the radar, and the argument is usually that the purchase price covers hard costs of materials, so there's no profit to sue over. Since Hasbro does not currently offer the product for sale, there's no confusion in the marketplace. Another argument for this would be that this is a legitimate "backup copy" of an old VHS tape, now defunt technology, which is legally protected by law. All this guy would have to do is produce aN original VHS copy for every DVD he sold, and claim he was just performing a service for his customers. In fact he more or less claims this - "for anyone who owns the VCR game". Since the cards are not included, or other game items, it presumes the buyer already has this. The seller could simply claim he was providing the buyer with a backup copy for an original VHS copy they warrant and represent to own by ordering the DVD. This is all perfectly legal.
